These Terms of Use govern your access to and use of the VayBazar platform. By using this site, you agree to these terms.
1. Purpose and scope
VayBazar is a Vaynakh marketplace enabling vendors to offer goods and services to site visitors. These terms apply to all users, whether browsing or registered as vendors. Access to certain features (creating a shop, publishing listings) is subject to acceptance of these terms and opening a vendor account.
2. Description of services
VayBazar provides a technical platform for: browsing shops and listings; connecting buyers and sellers; and for vendors, creating and managing one or more shops and publishing or editing listings. VayBazar is not a party to transactions between users and does not intervene in the terms of sale set by each vendor.
3. Registration and vendor account
To open a shop, you must create a vendor account by providing the requested information (including name, email address). You agree to provide accurate information and to keep your data up to date. You are responsible for the confidentiality of your credentials and for all actions carried out from your account.
4. User obligations
You agree to use the platform in good faith, in compliance with applicable laws and the rights of others. It is prohibited to publish illegal, misleading, defamatory content or content that infringes intellectual property. Vendors must describe their offerings accurately and honour their commitments to buyers. VayBazar reserves the right to remove any content or account in case of breach.
5. Intellectual property
The VayBazar brand, site design and editorial content of the platform are protected by intellectual property law. Vendors retain ownership of the content they publish (text, images) and grant VayBazar a licence to use it as necessary for the display and operation of the service.
6. Liability
VayBazar strives to ensure the availability and security of the platform but cannot guarantee uninterrupted service. VayBazar's liability is limited to direct and foreseeable damage attributable to a malfunction of the service. Disputes relating to transactions (quality, delivery, payment) are a matter for the direct relationship between buyer and seller.
7. Modifications and governing law
VayBazar may modify these terms at any time. Users will be informed of substantial changes (e.g. by email or message on the site). Continued use of the service after the new terms are posted constitutes acceptance. These terms are governed by French law. In the event of a dispute, the French courts shall have jurisdiction.

9. Prohibited listings and content
It is strictly forbidden to offer for sale or to promote on the platform the following listings, goods and services (non-exhaustive list): stolen or received goods; counterfeits and items infringing intellectual property; weapons, ammunition, explosives and related parts; drugs, narcotics, psychotropic substances and paraphernalia related to their use; medicines or regulated substances whose sale is illegal; human body parts, organs, human remains; items containing pork or non-halal substances; sale of animals (live or otherwise); hazardous materials (explosive, toxic, radioactive, corrosive); pornographic content or content involving the exploitation of minors; content inciting hatred, violence or discrimination; illegal gambling equipment; official documents, identity documents (fake or stolen); items subject to recall or sale prohibition for safety reasons; protected species or derived items whose trade is illegal; tobacco and alcohol; any other item or service whose sale or promotion is illegal in the relevant countries. VayBazar reserves the right to remove any listing and to suspend or close any account in case of breach of these prohibitions.
10. User-published content - moderation and liability
Listings and other content on the platform are created and published by vendors. VayBazar does not carry out systematic prior verification of each listing. We expressly prohibit the publication or sale of the listings and content referred to in section 9 and we endeavour, within our means, to enforce these rules (reports, ex post checks). As soon as we become aware of illegal content or content in breach of these terms, we act to remove it and, where appropriate, to suspend the account concerned. Given the volume of content and the open nature of the platform, VayBazar cannot however guarantee that all breaches have been detected. To the extent permitted by law, VayBazar disclaims any liability for illegal or prohibited content published by users without its knowledge or before it could identify and remove it. Liability rests with the authors of the content. Anyone who becomes aware of a listing or content that violates these terms is invited to report it to us at contact@vaybazar.com.
